RE: The tariff classification of a window curtain from China

Dear Mr. Budhrani:

In your letter, received by this office on, April 6, 2010, you requested a classification ruling.

You will be importing a window curtain. A sample of a portion of a window valance representing the construction of the window curtain was submitted with your request. The curtain will be made from 100 percent polyester fabric with damask like weave. The back of the fabric is coated with a textile flock. The flocking is composed of 87 percent cotton and 13 percent rayon. The curtain has a rod pocket at the top and the edges are finished with a self fabric binding.

The applicable subheading for the curtain will be 6303.92.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for curtains (including drapes) and interior blinds; curtain or bed valances: other: of synthetic fibers: other… window curtains (including drapes) and window valances. The rate of duty will be 11.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
